All users of Transfercar
1. Comply to terms and conditions
1.1 By registering as a user of Transfercar you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the Service.
1.2 These terms and conditions may be amended in whole or in part by Transfercar from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of Transfercar's services represents your agreement to be bound by the terms and conditions as amended.
2. The service
2.1 Transfercar facilitates contact between owners of relocation vehicles and drivers prepared to drive those vehicles.
2.2 Transfercar operates as a virtual service based on internet and phone communication.
2.3 Transfercar does not own or otherwise provide the physical vehicles to the driver; only information about who offers the vehicles is provided by Transfercar.
2.4 Transfercar does not hire out drivers or otherwise provide transportation for the relocation vehicles; only information about who are willing to drive the vehicles is provided by Transfercar.
2.5 Transfercar do not act as an agent for either owners of relocation vehicles or relocation drivers.
3. Risk
3.1 Transfercar gives no undertakings, representations or warranties in relation to information provided on or via the web application to vehicle owners or relocation drivers. This includes:
~ the accuracy of details provided about each listed vehicle;
~ as to whether the listed vehicle match the actual vehicle provided by the owner;
~ as to whether the owner of the vehicle cancels, withdraws or for any other reasons do not provide the car to the relocation driver;
~ as to whether the driver has provided the true information to Transfercar;
~ as to whether the driver cancels, does not show up or does not complete the relocation.
3.2 Transfercar does not take any responsibility for loss or damage to vehicle owner or cost or fines applying to relocation drivers relocating a particular relocation vehicle. Any dispute in that matter has to be solved directly between the vehicle owner and the relocation driver.
3.3 Transfercar makes its best effort to ensure all information on the website is accurate and up-to-date. However, Transfercar cannot and does not guarantee that errors do not occur from time to time.
4. Validate and update information
4.1 Transfercar reserves the right to validate and update all information provided to Transfercar by vehicle owners and relocation drivers.
Vehicle owners
1. Membership
1.1 It is free for vehicle owners to register and list relocation vehicles at Transfercar's website.
1.2 Transfercar reserves the right to terminate memberships or decline owners to re-register if that owner has breached the terms and conditions.
2. Listing vehicles
2.1 For any vehicle listed at Transfercar, the owner of the vehicle must allow the driver to drive the vehicle for minimum one day without charging any rental fee. If the vehicle owner must charge a fee due to insurance requirements, this will be at a charge of maximum $5.00 per day.
2.2 The vehicle owner is required to provide the most accurate information about each listing possible. Especially anything that may be seen as a compulsory cost to the driver must be listed, e.g. diesel tax, insurance cost if not included and airport tax. Any optional cost information such as insurance upgrade, linen hire, equipment hire etc. is also encouraged.
2.3 Owners can only list vehicles that exist and are to be relocated.
2.4 Vehicle owners can at any time withdraw any listed relocation vehicles as long as no relocation driver has been accepted. Once a relocation driver has been accepted the vehicle owner has committed to provide that vehicle to the driver, or find a suitable alternative.
2.5 Vehicle owners cannot list vehicles on behalf of other vehicle owners.
2.6 Vehicle owner is to appear anonymous in its listings and shall not use any company name, logo, web address, phone number, email address or other identifying information in the listing details, terms and conditions or optional extras details. Failure to comply with this can lead to disruption or in worst case cancelation of membership.
2.7 In the case where Transfercar lists vehicles on behalf of owners, all relocation details must be provided by the vehicle owner and is their responsibility to check the accuracy of the details for each vehicle listed. Transfercar takes no responsibility for the accuracy of this information or for the delivery of the free offers advertised on our websites.
3. Accept and reject drivers
3.1 It is entirely up to the discretion of the owner to accept and reject drivers.
3.2 The owner is required to accept and reject driver requests within 48 hours from the time the request is received. Repeated failure to do so can lead to disruption or in the worst case cancelation of membership.
4. Owner's account and termination
4.1 A fee applies to the vehicle owner when accepting a request from a relocation driver.
4.2 The owner needs to credit their Transfercar account to be able to accept a request. Payments to the account are facilitated through the secure payment system at Transfercar's website.
4.3 Unused credit that belongs to the owner can always be refunded and transferred to the bank account of the owner. A transaction fee of 4% of the full amount of the transfer applies.
4.4 Unused credit that has been given to the owner as part of promotions, bonus credit or not paid in by the owner is not subject to refund.
4.5 You must settle any negative account balance immediately. Transfercar reserves the right to take action against you to recover outstanding debts. You are liable for all expenses (including legal fees) that Transfercar incurs when collecting that debt.
5. Cancellations and no-shows (refund)
5.1 Transfercar provides refunds of the relocation fee when accepted drivers do not show up or cancels later than 48 hours from the pickup time. Transfercar has to be notified about the no-show or late cancellation by email, phone or through the website within 7 days from the pickup time.
5.2 The refund is paid to the rental operator's account with Transfercar.
5.3 A rental operator is not subject to a refund if the no-show or cancellation is caused by the operator not providing the vehicle to the driver, failure to inform about costs and charges (such as, but not limited to, credit card deposits) or in any other way fails to provide essential information about the listing.
Relocation drivers
1. Membership
1.1 It is free for drivers to register to, and request vehicles at Transfercar's website.
1.2 Transfercar reserves the right to terminate memberships or decline drivers to re-register if that driver has breached the terms and conditions.
2. Registering
2.1 As part of registering to Transfercar, you must provide true, accurate and current information to Transfercar including full name, date of birth and contact details. Transfercar may call or email to verify these details.
2.2 You may only register as a driver if you are 18 years or older. By registering as a driver, you warrant that you can form a legally binding contract.
3. Request a vehicle
3.1 When requesting a vehicle, you must provide a valid credit card and accept the terms and conditions.
3.2 You permit Transfercar to pass on your contact details to the owner of that particular vehicle.
3.3 A request is no guarantee that you will be able to drive the vehicle. Only if accepted by the vehicle owner (notified by email, phone or website) should you consider the vehicle booked.
3.4 It is your responsability to make sure all the relocation details fit your requirements. If there is any information not specified in the listing that will affect your decision to take the vehicle, it is up to you to contact [email protected] to find these details out prior to requesting the vehicle.
3.5 Should your request be accepted, you commit to picking-up the vehicle according to the details provided by the owner of the vehicle and your preferred pick-up date as specified when requesting the vehicle.
3.6 You cannot request a vehicle on behalf of another person.
3.7 You can request more than one vehicle at a time if: (1) you intend to relocate more than one vehicle, e.g. in Australia from Sydney to Melbourne and continue travelling from Melbourne to Perth or in New Zealand travelleing from Auckland to Wellington and then Wellington to Christchurch. However the pick-up date cannot be the same. (2) You can request more than one car at a time for the same route and for the same pick-up date. If you get accepted for one vehicle for that particular route and pick-up date your other pending requests will automatically be deleted.
4. Vehicle pick-up and agreement with the rental car company
4.1 The relocation driver must show up at the location specified by the vehicle owner at the agreed date and time.
4.2 The driver is expected to sign a contract directly with the vehicle owner prior to the handover of keys.
4.3 The driver may have to pay petrol, insurance and other expenses if they are not covered by the rental car company as specified in the listing details. Other expenses may include airport tax or diesel tax that are collected by the rental car company but paid to the government or airport. Compulsory cost must be displayed by the rental car company when listing the vehicle. Optional cost may include insurance upgrades, linen hire and equipment hire. The rental car companies are not required to display optional costs when listing vehicles at Transfercar. If the vehicle owner must charge a daily fee due to insurance requirements, this will be at a charge of a maximum of $5.00 per day and the driver will be required to pay for this additional charge.
5. Cancelations
5.1 Any cancellations must be notified in writing (e.g. email) and with a phone call directly to the rental operator no later than 48 hours prior to the agreed pickup time. Failure to do so might incur a no-show/cancellation fee of $100.00 which will be taken directly from the driver's credit card. Cancellations on bookings made less than 48 hours of pickup time will automatically incur the cancellation fee.
5.2 The vehicle owner may also operate with separate cancellation/no-show fees.
5.3 Failure to pick-up the vehicle without notifying the rental operator is considered a serious breach of Transfercar's terms and conditions and will result in the driver being charged a no-show fee of $100.00 to the driver's credit card.
5.4 Requesting vehicles from Transfercar's website without having any intention of completing the relocation is considered a breach of Transfercar's terms and conditions and will result in the driver being charged a no-show fee of $100.00 to the driver's credit card.
5.5 When requesting a vehicle from Transfercar's website, the driver accepts that Transfercar can charge the driver's credit card a no-show/cancellation fee of $100.00 for any offence under 5.1, 5.3 and 5.4 of these terms and conditions.
5.6 The no-show/cancellation fee can be charged from the driver's credit card when Transfercar has been notified by the rental operator about the no-show/cancellation. Transfercar will notify the driver by email that a no-show/cancellation fee has been charged.
5.7 Any dispute in regards to a no-show/cancellation fee must be sent directly to Transfercar by phone or email within 7 days from when the no-show/cancellation fee was charged.
6. No-shows and misuse of the Transfercar service
6.1 Failure to pick-up the vehicle without notifying the vehicle owner is considered a serious breach of the Transfercar's terms and conditions and will be penalized with a no-show fee to driver's credit card.
6.2 Requesting vehicles from Transfercar's website without having any intention of completing the relocation is considered a serious breach of Transfercar's terms and conditions and will be penalized with a no-show fee to the offender for each vehicle that is subject to this offence.
6.3 When requesting a vehicle from Transfercar's website, the driver accepts that Transfercar can charge the driver's credit card for any offence under 6:1 and 6:2 of these trems and conditions.
6.4 The no-show fee can be charged from the driver's credit card when Transfercar has been notified by the vehicle owner about the no-show. Transfercar will notify the offender by email that a no-show fee has been charged.
6.5 Any dispute in regards to a no-show fee must be sent directly to Transfercar by phone of email within 7 days from when the no-show fee was charged.
